How is child custody determined in Ontario?

Child custody is decided based on the best interests of the child. The court considers factors such as the child's relationship with each parent, their routine, stability, and each parent's ability to meet their needs. Ontario has moved away from the term "custody" and now uses decision-making responsibility and parenting time to define parental rights and responsibilities.

How is child support calculated?

Child support is based on the Federal Child Support Guidelines, which consider the paying parent's income and the number of children. Additional expenses like daycare, medical costs, and extracurricular activities may also be shared between parents.

How long does the divorce process take in Ontario?

An uncontested divorce can take as little as 4–6 months, while a contested divorce — involving disputes over assets, support, or custody — can take a year or more, depending on court availability and complexity.

Do I have to go to court for a divorce or family law dispute?

Not necessarily. Many family law matters in Ontario are resolved through mediation, arbitration, or negotiation without court involvement. However, if agreements can't be reached, court intervention may be necessary.

How is property divided in a divorce?

Ontario follows the equalization of net family property rule, meaning that any increase in assets during the marriage is typically split 50/50. However, assets like inheritances, gifts, and pre-marital property may be excluded in certain cases.

Am I entitled to spousal support?

Spousal support depends on factors such as the length of the marriage, each spouse's income and financial needs, and whether one spouse sacrificed career opportunities for the marriage. The Spousal Support Advisory Guidelines help determine amounts, but each case is unique.
